1. Acceptance of Terms

By accessing or using the Herbacy website, application, or any related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

We reserve the right to update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the revised Terms. We will notify registered users of material changes via email or in-app notification.

2. Description of Service

Herbacy is an educational safety tool that provides information about potential interactions between dietary supplements, herbal products, and medications. The Service aggregates data from peer-reviewed medical databases and presents it in an accessible format.

3. User Accounts

Certain features of the Service require account registration. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information during registration and to update it as necessary.

You must be at least 18 years old to create an account. By creating an account, you represent that you meet this age requirement.

4. Herbacy Is Not a Medical Device

You expressly acknowledge and agree that:

  • Herbacy is an educational information tool and is not intended to be used as a substitute for professional medical advice, diagnosis, or treatment.
  • Interaction data, safety scores, and risk assessments presented by the Service are for informational purposes only and should not be relied upon as the sole basis for healthcare decisions.
  • You should always consult a qualified healthcare provider before starting, stopping, or changing any supplement, herbal product, or medication.
  • Herbacy has not been evaluated or approved by the FDA, EMA, or any other regulatory body as a medical device or clinical decision support tool.

5. Limitation of Liability

To the fullest extent permitted by applicable law, Herbacy and its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to:

  • The accuracy, completeness, or timeliness of interaction data or safety assessments provided by the Service.
  • Any health outcomes, adverse reactions, or medical decisions made in reliance on information provided by the Service.
  • Any interruption, suspension, or termination of the Service.
  • Unauthorized access to or alteration of your data or transmissions.

Herbacy is a free service. In no event shall Herbacy's total liability to you exceed fifty US dollars ($50).

6. Interaction Data Accuracy

While we strive to maintain accurate and up-to-date interaction data sourced from peer-reviewed medical literature and established pharmacological databases, we do not warrant or guarantee that:

  • All known interactions are included in our database.
  • The severity ratings or evidence levels assigned to interactions are definitive or universally accepted.
  • The information reflects the most recent research at all times.

Our database is regularly reviewed and updated, but medical science evolves continuously. The absence of a listed interaction does not mean no interaction exists.

7. Affiliate Links and Purchases

Herbacy is a free service. We earn revenue through affiliate links when you purchase recommended supplements on Amazon:

  • Amazon Associates: Herbacy is a participant in the Amazon Services LLC Associates Program, an affiliate advertising program designed to provide a means for sites to earn advertising fees by advertising and linking to Amazon.com.
  • Product recommendations: Product recommendations are based on safety data and suitability as alternatives to flagged supplements. We do not guarantee the quality, efficacy, or safety of any third-party product sold on Amazon.
  • Pricing: Product prices displayed on Herbacy are cached from Amazon and may not reflect the current price at the time of purchase. The price you pay is determined by Amazon at checkout.

8. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of applicable regulations.
  • Attempt to reverse-engineer, decompile, or extract source code from the Service.
  • Scrape, crawl, or systematically extract data from the Service without prior written consent.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. You may request export of your data prior to account deletion in accordance with our Privacy Policy.

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Delaware.
